General
The following General Terms and Conditions conclusively and exclusively govern the conclusion of the contract and its execution. House of Tales GmbH (hereinafter: “House of Tales”), Zimmerstraße 90, 10117 Berlin offers the customer (hereinafter: “Customer”) services and products in the area of Escape Games, city rallies and online games. House of Tales® reserves the right to change, close or remove elements for technical, operational or other reasons without prior notice. In such cases, no refund of the admission price can be made.
1 Conclusion of Contract
1.1 Registration for the event can be made via the website, by telephone or by email. Escape Games, city rallies and online games are offered for booking via the website (houseoftales.de), as well as gift vouchers for these leisure activities. The presentation and advertising of the various products do not constitute a binding offer to conclude a contract. The customer can choose between the events offered. Available dates can be seen in the calendar view. By confirming the “to checkout” button, the customer registers bindingly for the game in the desired time slot. Only upon allocation and transmission of the order number by House of Tales to the customer is a contract concluded. The sending of the order confirmation constitutes delivery of the ticket for participation in the event.
In the event that the customer has ordered a voucher, the voucher code will be communicated in the booking confirmation via email. This entitles the customer or a person to whom the customer passes on the voucher to use the voucher amount as a means of payment when booking Escape Games and city rallies.
2 Cancellation
2.1 The purchase of vouchers can be revoked in accordance with No. 6.
2.2 When purchasing tickets for participation in Escape Games and rallies, cancellation is not possible (cf. No. 6.1). This applies regardless of the chosen payment method.
Our goodwill regulations:
You can cancel or rebook appointments free of charge up to 7 days before the event. Please send an email to hello@houseoftales.de with the booking number and the desired change.
Within the 7 days to 48 hours before the event, free rebooking is possible or the ticket price can be converted into a gift voucher. The gift voucher is valid for 6 months.
For cancellations and rebookings less than 48 hours before the start of the game, a cancellation fee of €50 per room/rally applies. The remaining amount will be converted into a gift voucher.
There is no entitlement to our goodwill regulations.
3 Payment
3.1 After ordering, the total price is due for immediate payment upon conclusion of the contract for the payment methods PayPal, instant bank transfer, credit card, GiroPay and invoice, if these payment methods are offered.
3.2 If the payment method “cash payment on site” is offered, the total price of the order is due on the day of the event and must be paid in cash at the branch before the start of the game. Payment by debit card or credit card is possible.
4 Subject of the Contract “Tickets”
4.1 Please note that House of Tales is a live event. If the customer arrives late, the playing time will be reduced accordingly. In case of non-appearance, the customer’s claim to the event expires. The obligation to pay the total price remains.
4.2 The ticket purchased by the customer entitles the customer and other persons named by them to participate in the booked game at the date and time indicated on the ticket.
4.3 House of Tales is a team game for people aged 10 and over. Children up to 14 years must be accompanied by a legal guardian. The offered Escape Games are generally not suitable for children under 10 years.
4.4 From the age of 6, children are considered “full payers” when accompanied by adults in the game rooms. Under 6 years, children can join the game free of charge by written agreement, but maximum participant numbers must be observed.
5 Vouchers
5.1 Vouchers for leisure events can be purchased via the website and directly on site. The vouchers are valid exclusively for the payment of tickets for leisure events offered by House of Tales.
5.2 A claim for cash payment of vouchers against House of Tales is excluded as long as the service is offered.
5.3 The validity period of the vouchers is 12 months from the date of issue (purchase). An extension of the validity periods is not possible.
6 Right of Withdrawal
6.1 When purchasing tickets for Escape Games and rallies, a contract for the provision of services in connection with leisure activities is concluded, which provides for a specific date or period for provision (cf. § 312g (2) No. 9 BGB). There is therefore no right of withdrawal for the customer pursuant to § 312g (2) No. 9 BGB, regardless of the chosen payment method.
6.4 For all other voucher purchases, the following applies to contracts with consumers:
Right of Withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us (House of Tales GmbH, Zimmerstraße 90, 10117 Berlin, info@houseoftales.de) by means of a clear statement.
Consequences of Withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal. We will use the same means of payment for the refund that you used for the original transaction.
7 Image and Video Recordings
7.1 The customer agrees to being observed by the game masters via a screen during the leisure activities. This serves the safety of the customers. The recordings are not stored.
7.2 Furthermore, we point out that surveillance cameras are installed in the entrance and common areas.
8 Data Protection Notes
8.1 House of Tales collects customer data as part of the processing of contracts. House of Tales complies in particular with the provisions of the Federal Data Protection Act and the Telemedia Act. Without the customer’s consent, House of Tales will only collect, store, process or use personal data of the customer insofar as this is necessary for the processing of the contractual relationship.
9 Retention of Title
9.1 House of Tales retains ownership of the purchased item until full payment of the total price if the customer is a consumer.
9.2 If the customer is an entrepreneur, House of Tales retains ownership of the purchased item until settlement of all outstanding claims from the business relationship.
10 Liability
10.1 Subject to the following exceptions, the liability of House of Tales for contractual breaches of duty and from tort is limited to intent or gross negligence. In the following cases, House of Tales is liable without limitation: under the Product Liability Act, for intentionally or grossly negligently caused damages, for damages from injury to life, body or health, and for damages from breach of a guarantee.
10.2 Insofar as a violation of essential contractual obligations is based only on simple negligence, the liability of House of Tales is limited to compensation for the typical and foreseeable damage.
10.4 House of Tales is not liable for lost clothing or lost valuables. House of Tales assumes no liability for clothing damaged during the leisure activities.
10.5 We also point out that the premises may contain technical installations such as 12V magnets, flickering lights and natural products that may trigger symptoms of conditions such as epilepsy or allergies. House of Tales assumes no liability for this.
11 Applicable Law and Jurisdiction
11.1 The law of the Federal Republic of Germany applies exclusively.
11.2 If the customer is an entrepreneur pursuant to § 14 BGB, the sole place of performance for delivery and payment is the registered office of House of Tales.
11.3 The European Commission provides a platform for online dispute resolution (OS): www.ec.europa.eu/consumers/odr.
12 House of Tales House Rules
By entering the event premises of House of Tales, customers and visitors acknowledge the validity of the following house rules:
1. Persons displaying fascist and/or inhumane emblems, brands and/or making fascist and/or inhumane statements will be expelled from the premises and immediately banned!
2. Cutting, shooting or stabbing weapons are prohibited on the premises.
3. The production of photo, audio, video or other media recordings for commercial use without the express prior consent of House of Tales is not permitted.
4. Animals are not permitted on the premises for the safety of our customers.
5. Visitors who are obviously under the excessive influence of drugs or alcohol or show signs of contagious diseases may be denied access.
6. In the event of non-compliance with the house rules, game rules or instructions, we reserve the right to terminate the game. In this case, the ticket cannot be refunded.
