The following General Terms and Conditions govern exclusively the conclusion of the contract as well as its execution.The von Freeden & Oberbeck GmbH (hereinafter: "House of Tales"), Zimmerstraße 90, 10117 Berlin offers (hereinafter: "Client") services and products in the field of Escape Games, city rallys and online games.House of Tales® reserves the right to change, close or remove elements for technical, operational or other reasons without prior notice. In such cases, no refund of the ticket or product fee can be made.
1 Conclusion of contract
1.1 Event bookings can be made via the website, by telephone or by e-mail. Via the website (houseoftales.de), Escape Games, city rallyes and online games can be purchased as well as gift vouchers for all products and events. The presentation and advertising of the various products do not constitute a binding offer to conclude a contract. The customer can choose between the offered events. Available dates are shown in the calendar view. With the confirmation of the button "checkout", the customer registers bindingly for the game in the booked period in the desired time slot. To enter a booking, House of Tales first asks for data such as name, e-mail address, telephone number and, if applicable, billing address of the customer. By confirming the order and clicking on the button "Order now", the customer submits a binding offer. A contract between the Client and House of Tales is only concluded when House of Tales confirms the booking and sends the order number to the Client. The sending of the order confirmation equals the delivery of the ticket for participation in the event. Before submitting the booking, the client can view and change their entries at any time. The booking confirmation must be checked for any errors by the Client immediately; any errors must be communicated to House of Tales in writing.When booking via mail or telephone, the client can choose between the offers and communicate their required information.
In the event that the Client has ordered a gift voucher, they will be informed of the voucher code in the booking confirmation in the form of an e-mail. This entitles the customer, or a person to whom the customer passes on the gift voucher, to use the voucher amount as a means of payment when booking Escape Games and city rallyes or paying at the location for the event.
2 Cancellation
2.1 The purchase of gift vouchers can be canceled in accordance with No. 6.
2.2 Cancellation is not possible when purchasing tickets to participate in Escape Games as well as rallies (cf. No. 6.1.). This applies regardless of the chosen payment method.
Our goodwill regulations:
You can cancel or rebook appointments free of charge up to 7 days before the event. Please send an email to [email protected] with the booking number and the change request.
Within the 7 days to 48 hours before the event, you can rebook free of charge or convert the ticket price into a voucher. The voucher is valid for 6 months.
Cancellations and rebookings made less than 48 hours before the start of the event will incur a cancellation fee of 50€ per room/rally. The remaining amount will be converted into a voucher.
If more than two rooms/stories have been booked, cancellation must be made at least 14 days before the start of the event. If this deadline is not met, the ticket price for the minimum number of people for the booked rooms/rallies will be charged for each booked room/rally.
The student rate can be adjusted up to a minimum number of 15 tickets.
All appointments booked as part of a promotion are exempt from these cancellation conditions. In this case, the cancellation conditions on the promotion page apply.
There is no entitlement to our goodwill regulations.
3 Payment
3.1 After the order has been placed, the total price is due immediately after conclusion of the contract for the payment methods Paypal, Instant bank transfer, credit card, GiroPay and invoice, if these payment methods are offered.
3.2 If the payment method "cash payment on site" is offered, the total price of the order is due on the day of the event, in deviation from 3.1, and must be paid in cash on site at the event location before starting the game. Payment by EC card or credit card is also possible.
4 Subject of the contract "Tickets"
4.1 Please note that House of Tales is a live event. If the customer appears late, the event time will be reduced according to the delay. In case of non-appearance, the customer's right to the execution of the event is forfeited. The obligation to pay the total price of the order remains, cf. clause 3.
4.2 The ticket purchased by the Client for participation in the Escape Game, as well as rallyes entitles the Client and other persons named by the Client to participate in the booked event on the date noted on the ticket (the order confirmation) at the specified time.
4.3 House of Tales is a team game for persons of 10 years and older. Children up to 14 years of age must be accompanied by a parent or guardian. Otherwise, admission may be denied. The Escape Games offered are generally not suitable for children under 10 years of age. For individual stories / events, the minimum age may differ. This is then noted on the website and the associated minimum age applies.
4.4 From the age of 6, children are considered "full payers" when accompanied by adults in the game rooms. Children under 6 years of age may join the game free of charge upon written agreement of House of Tales and in accordance with the number of adults, as long as the regulations for the maximum number of participants and the specifics of the event are followed. This rule can be waived by House of Tales in context of individual group conditions.
5 Vouchers
5.1 Gift vouchers for an event can be purchased via the Website and directly on site. The vouchers are exclusively valid for the payment of tickets for the participation in events offered by House of Tales.
5.2 A claim for cash payment of a gift voucher against House of Tales is excluded as long as the event is offered.
5.3 Vouchers are valid for three years from the date of purchase.
6 Right of revocation
6.1 When purchasing tickets for participation in Escape Games as well as rallyes, a contract for the provision of services in leisure events is concluded between House of Tales and the Client, which provides a specific date or period for this provision (cf. § 312 g para. 2 no. 9 BGB). Therefore, according to § 312 g para. 2 no. 9 BGB, there is no right of withdrawal for the customer, regardless of the chosen method of payment. Each purchase of tickets for participation in Escape Games as well as rallies is thus binding immediately after confirmation according to 3.1 by House of Tales and obligates the Client to pay the total price of the order.
6.2 Right of revocation for the purchase of digital goods
With the buyer's consent to the right of withdrawal, the client agrees, when purchasing a digital good, that the executing company will start carrying out the contract before the expiration of the withdrawal period and that the digital good will be made available to the customer. In addition, the buyer agrees to losing his right of withdrawal as soon as the contract has been executed.
6.3 In the case of a purchase of a gift voucher that takes place in the simultaneous physical presence of the contractual partners or their authorized representatives (e.g. purchase on-site), there is no remote sales contract within the definition of § 312 b BGB. The customer therefore has no right of revocation.
6.4 For all other gift voucher purchases, the following shall apply to contracts with consumers:

You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us, von Freeden & Oberbeck GmbH, Zimmerstraße 90, 10117 Berlin, [email protected] means of a clear, written declaration (e.g. a letter or e-mail) of your decision to revoke this contract. To comply with the revocation period, it is sufficient that you send your declaration of the exercise of the right of revocation before the expiration of the revocation period.
6.4.3 Consequences of the revocationIf you revoke this contract, we shall reimburse you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless explicitly requested otherwise by you; in no case will you be charged any fees in connection with this reimbusement. We may refuse repayment until we have re-received the goods or you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You will only be charged for any loss in value of the goods if this loss in value is due to your handling of the goods, which is not necessary for the examination of the condition, properties and functioning of the goods. End of the cancellation policy.
6.5 House of Tales deactivates the voucher. If the voucher has already been paid before revocation, House of Tales will refund the purchase price to the customer.
7 Picture and video recordings during the the events
7.1 The Customer agrees to be observed by the game masters via a screen during the event. This is for the safety of the customer. The recordings will not be stored.
7.2 Furthermore, we point out that surveillance cameras are installed in the entrance and common areas. 8 Notes on data protection and data processing
8.1 House of Tales collects data of the customer in the context of the processing of contracts.
In doing so, House of Tales particularly observes the regulations of the Federal Data Protection Act and the Telemedia Act. Without the consent of the Client - e.g. in accordance with the data use declaration possibly issued by the Client - House of Tales shall only collect, store, process or use personal data of the Client to the extent that this is necessary for the processing of the contractual relationship and for the use and billing of telemedia.
9 Retention of Title
9.1 House of Tales retains ownership of the purchased item until full payment of the total price of the order if the client is a consumer. The corresponding retention rights may be transferred to third parties.
9.2 If the Client is an entrepreneur acting in the course of his business or a special fund under public law or a legal entity under public law, House of Tales shall retain ownership of the purchased item until all outstanding claims arising from the business relationship with the Client have been settled. The corresponding retention rights may be transferred to third parties.
10 Liability, exclusion of withdrawal in case of certain breaches of duty
10.1 Excluding the following exceptions, the liability of House of Tales for contractual breaches of duty and for tortious acts is limited to intent or gross negligence. In the following cases, House of Tales shall be liable without limitation: under the Product Liability Act, for damage caused intentionally or by gross negligence, in the event of fraudulent concealment of defects, for damage resulting from injury to life, body or health and for damage resulting from the breach of a warranty.
10.2 Insofar as a breach of essential contractual obligations (so-called cardinal obligations) is only based on simple negligence, the liability of House of Tales shall be limited to the compensation of the contract-typical and foreseeable damage.
10.3 Except for the cases mentioned in paragraphs 10.1 and 10.2, House of Tales is not liable for damages caused by simple negligence.
10.4 House of Tales is not liable for lost wardrobe or lost or stolen valuables. House of Tales does not assume any custody responsibility in this respect. House of Tales accepts no liability for items of clothing which are damaged during the course of the event.
10.5 Furthermore, we would like to point out that the available premises and products may contain technical equipment, such as 12 V magnets, flickering lights and natural products, which may trigger symptoms of illnesses such as epilepsy or allergies. House of Tales assumes no liability for this.
10.6 Insofar as the liability of the House of Tales is excluded or limited according to clauses 10.1 to 10.5, this also applies to the liability of its vicarious agents.
11 Applicable law and place of jurisdiction
11.1 The law of the Federal Republic of Germany shall apply exclusively.
11.2 If the Client is an entrepreneur pursuant to § 14 BGB (German Civil Code), the sole place of performance for delivery and service as well as payment shall be the registered office of House of Tales.
11.3 The European Commission provides a platform for online dispute resolution (OS), which can be found here: EU Commission Online Dispute Resolution Platform: www.ec.europa.eu/consumers/odr Consumers have the option to use this platform to resolve their disputes.
12 House of Tales House Rules
With access to the event rooms of House of Tales, the customers and visitors recognize the validity of the following house rules regulated by private law:
1. persons who are conspicuous by wearing fascist and / or inhuman emblems, brands and / or by fascist and / or inhuman statements will be asked to leave and are banned from the event premises immediately.
2. cutting, shooting or stabbing weapons are forbidden in the event rooms.
3. the producing of photo, audio, video or other media recordings for commercial use in the facility without written, prior consent of House of Tales is not permitted. We will also ask in the interest of the game experience before the start of the game to hand over image and sound recording devices, especially cell phones.
4. animals are not allowed in the event rooms for the safety of our customers and for their own protection.
5. visitors who are obviously under the excessive influence of drugs or alcohol, or who are suspected of having a contagious disease within the meaning of the Federal Epidemics Act or the Infection Protection Act, or similar diseases that pose a risk to safety, may be denied access to the premises.
6. in case of non-compliance with the house rules mentioned here, the rules of the game explained in the briefing or the instructions in the game, we reserve the right to abort the game. In this case, the ticket cannot be refunded.
